Terms of Service

Welcome to TechHaulers. These Terms of Service ("Terms") govern your access to and use of the website located at https://www.techhaulers.com (the "Site") and any services scheduled or requested through the Site (the "Services"). The Site and Services are operated by CL Tech Recycling LLC ("TechHaulers," "we," "us," or "our").

By accessing or using our Site or Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site or Services.

1. Definitions

  • "Services" means the eWaste collection, recycling, data destruction, IT asset disposition (ITAD), and related services offered by TechHaulers, including scheduling a pickup through the Site.

  • "You" or "User" means any individual or entity accessing or using the Site or Services.

  • "Content" means all text, images, graphics, logos, and other materials displayed on the Site.

2. Use of the Site

2.1 Eligibility

You must be at least 18 years of age and legally able to enter into contracts to use the Site or request Services. If you are scheduling a pickup or requesting Services on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2.2 Permitted Use

You agree to use the Site only for lawful purposes. You will not:

  • Use the Site in any way that violates applicable local, state, national, or international law or regulation.

  • Attempt to gain unauthorized access to any part of the Site, its server, or any database or system connected to the Site.

  • Introduce viruses, malware, or other malicious code to the Site.

  • Use automated scripts, bots, or scraping tools to extract data from the Site without our prior written consent.

  • Impersonate any person or entity or misrepresent your affiliation.

  • Interfere with or disrupt the Site or servers or networks connected to the Site.

2.3 Intellectual Property

All Content on the Site, including text, graphics, logos, images, and software, is the property of TechHaulers or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may view and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works of the Content without our prior written consent.

Trademarks "TechHaulers," the TechHaulers logo, and other marks displayed on the Site are trademarks of CL Tech Recycling LLC. All other trademarks are the property of their respective owners.

3. Services

3.1 Scheduling and Availability

Pickups and Services scheduled through the Site are subject to availability. We will confirm scheduled pickups by email or phone. We reserve the right to refuse, reschedule, or cancel a pickup at our discretion, including but not limited to situations where:

  • The eWaste quantity or type does not match the submitted request.

  • Access to the pickup location is unsafe or impractical.

  • Weather, road conditions, or other circumstances prevent safe transport.

  • The materials presented are not electronic waste or are otherwise outside our scope of services.

3.2 Free Pickup Service

TechHaulers offers free eWaste pickup in participating municipalities and service areas. "Free" refers to no charge to the resident or business for the pickup service itself. Certain premium services (e.g., certified data destruction, on-site hard drive shredding, enterprise-level ITAD) may incur fees, which will be disclosed before service is rendered.

3.3 Accepted and Excluded Materials

We accept most categories of electronic waste, including but not limited to: computers, laptops, monitors, TVs, printers, peripherals, networking equipment, gaming systems, mobile phones, cables, and circuit boards.

We may refuse to accept:

  • Hazardous materials that are not electronic waste (e.g., paint, chemicals, batteries not integral to devices, medical waste).

  • Appliances containing refrigerants (unless separately arranged).

  • Radioactive materials.

  • Any materials prohibited by federal, state, or local regulations for transport and processing.

We reserve the right to inspect materials at the time of pickup and decline items at our discretion.

3.4 Data Destruction and ITAD Services

When you request data destruction or ITAD services:

  • You represent that you have the legal right to dispose of the devices and that all data on the devices is intended for destruction.

  • TechHaulers follows NIST 800-88 and IEEE 2883-2022 methodologies for data sanitization and destruction where applicable.

  • A Certificate of Data Destruction will be provided upon request and is recommended for all business and enterprise clients.

  • TechHaulers is not liable for data that was not properly identified, backed up, or removed by you prior to pickup. We strongly recommend you back up any data you wish to retain before scheduling a pickup.

  • Once devices are received and processed, data recovery is not possible.

3.5 Material Ownership and Transfer

By scheduling a pickup and tendering materials to TechHaulers, you transfer ownership of those materials to TechHaulers for the purpose of recycling, refurbishment, resale, or material recovery. Once materials are loaded onto our vehicle or dropped off at our facility, ownership transfers and materials cannot be returned.

3.6 Compliance Certifications

TechHaulers follows R2 (Responsible Recycling) and e-Stewards standards. Our compliance engine tracks chain-of-custody from pickup through final disposition. We make reasonable efforts to ensure all downstream processors meet applicable environmental and safety standards.

4. Accounts and Registration

If the Site offers account registration in the future, you are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Disclaimers

5.1 No Warranty

The Site is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, TechHaulers disclaims all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

5.2 Service Limitations

While we strive to provide reliable Services, we do not guarantee that any pickup will occur on a specific date or time. Weather, traffic, staffing, and operational constraints may cause delays. We will make reasonable efforts to communicate delays and reschedule promptly.

6. Limitation of Liability

To the fullest extent permitted by applicable law, TechHaulers, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Site or Services, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or related to the Site or Services shall not exceed the amount you paid to TechHaulers for the specific Service giving rise to the claim, or $100 USD, whichever is greater. For free Services where no payment was made, our total aggregate liability shall not exceed $100 USD.

This limitation of liability does not apply to liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or fraud.

7. Indemnification

You agree to indemnify, defend, and hold harmless TechHaulers, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of:

  • Your use of the Site or Services.

  • Your violation of these Terms.

  • Your violation of any law or the rights of a third party.

  • Any inaccurate or misleading information you provide when scheduling a pickup.

  • Any materials you tender that are hazardous, illegal, or not properly described, causing harm or regulatory action.

8. Privacy

Your use of the Site is also governed by our Privacy Policy, available at https://www.techhaulers.com/privacy-policy, which is incorporated into these Terms by reference.

9. Third-Party Links and Content

The Site may contain links to third-party websites or display third-party content. We do not control and are not responsible for the content, accuracy, or practices of these third parties. You access third-party sites at your own risk.

10. Modifications to Terms

We may modify these Terms at any time by posting the updated Terms on the Site and updating the "Last updated" date. Your continued use of the Site after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

11. Termination

We may suspend or terminate your access to the Site at any time, without notice, for any reason, including violation of these Terms. Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership, warranty disclaimers, indemnity, and limitation of liability.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.

12.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Site or Services shall first be addressed through good-faith negotiation. If the dispute cannot be resolved within 30 days, the dispute shall be submitted to binding arbitration in Mohave County, Arizona, under the commercial rules of the American Arbitration Association. The arbitrator's decision shall be final and binding. Judgment may be entered in any court of competent jurisdiction.

12.3 Class Action Waiver

You agree that any arbitration or litigation shall be conducted on an individual basis and not as a class action or representative proceeding. You expressly waive any right to participate in a class action or representative proceeding.

13. General Provisions

  • Severability: If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.

  • Entire Agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and TechHaulers regarding the Site and Services.

  • Waiver: Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.

  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

  • Force Majeure: We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, labor disputes, governmental actions, or equipment failures.
